1. The Pastor of St. Michael Parish is Ex-Officio Manager of St. Michael Cemetery.
2. A Board of Managers shall consist of the following officers: President, Vice President, Superintendent, Assistant Superintendent, Secretary/Treasurer, four additional Managers, and one Legal Advisor.
3. St. Michael Cemetery shall be designed, graded and ornamented under the direction of the Board of Managers. The Superintendent, with the assistance of the Board of Managers, shall keep the Cemetery in good condition including all grave sites, roadways, fences and landscaping. The Superintendent, with the assistance of said Board of Managers, shall plant trees, shrubs and flowers whenever it may be deemed advisable.
4. For Traditional Grave Sites, no alteration of grades of lots by lot-owners shall be permitted. Lot-owners may place flowers in pots on the graves of their respective lots. In no case will they be permitted to entirely remove the sod from the tops of the graves, or plant trees, shrubbery, or vines of any kind, as the Board of Managers is desirous of maintaining uniformity of design in the cemetery. Flower vases of iron or stone (no glass containers are permitted) or trellises of wire with hanging baskets may be placed on burial lots, provided the vases and trellises are movable.
5. Neither fences, hedges, posts, enclosures of any kind around lots, nor footstones shall be allowed on Traditional Grave Sites. Lot marks will be set by and at the expense of the Board of Managers.
6. All full size casket burials in Traditional Grave Sites will require a vault.
7. Upon payment-in-full for a grave site, the purchaser shall receive a Grave Site Certificate, entitling them to the perpetual holding and use of said lots for the burial of human remains, subject to the Rules and Regulations of the Cemetery, the Discipline of the Catholic Church, and the Laws of the Diocese of Toledo, now in force or that may hereafter be adopted with regard to burials and funerals. Purchase of a grave site or niche by non-members of St. Michael Parish will be charged $100.00 more than the rate for Parish members.
8. Upon the death of a lot-holder, all rights pass to whoever shall be entitled, in a lawful manner, to hold such lot. If several persons are equally entitled to such rights, the consent of each (in writing) must be obtained before any further transfer of rights will be permitted.
9. For Traditional Grave Sites: Inscriptions for a monument or headstone, stating more than names and dates, must be submitted to the Board of Manager for approval. Monuments may be of any desired size, but must not over extend lot size, and must be placed at head of lot only, on foundation installed by the Board of Managers.
10. For Traditional Grave Sites, all foundations will be poured under the supervision of the Board of Managers and charged to the company placing the monument or marker. All charges will be at the current prevailing rates.
11. All persons employed by the Cemetery shall be subject to the control and direction of the Board of Managers and if they fail or refuse to comply with Regulations of the Cemetery, they shall not be permitted to again work in the Cemetery under any pretext whatsoever.
12. Transfers, changes, and alienation of graves, if ever advisable or necessary, may be made only through the Board of Managers, with their consent and under their control. The cash refund for the released grave (or portion thereof) shall be determined by the Board of Managers in keeping with the original purchase price of said grave.
13. It shall not be permitted to inter in a grave anyone not an immediate relative of the Grave Site Certificate owner. No Grave Site Certificate owner shall receive compensation for an interment and no removal from a grave shall take place without the written consent of the Board of Managers.
14. All work in the Cemetery must be done by the Superintendent under the direction of the Board of Managers.
15. The Superintendent and Assistant Superintendent are responsible for the sale of graves and their care. Current prices are available on the Cemetery website, from the Board of Managers, parish office or local funeral directors.
16. Grave Site Certificate owners and their heirs and assignees agree to accept, observe and abide by the Rules of Cemetery now in effect. The right is reserved by the Board of Managers to modify these regulations whenever and inasmuch as it shall be deemed expedient or necessary. And any modifications shall have the same binding effect upon present and future Grave Site Certificate owners and their heirs and assignees.
